Terms of Use

These Terms of Use ("Terms") are an agreement between you and BitCraftery ("we," "our," or "us") — a trading name of a sole trader based in the United Kingdom, not a registered company — governing your use of the Weighly app. By downloading or using Weighly, you agree to these Terms. If you do not agree, please do not use the app.

The App

• Weighly is a personal weight, calorie, and workout tracking app. It is free to use, with no subscriptions, in-app purchases, or adverts.
• We grant you a personal, non-exclusive, non-transferable, revocable licence to use Weighly on Apple-branded devices or Android devices that you own or control, in line with the App Store Terms of Service or the Google Play Terms of Service respectively.
• Signing in is required to use the app — with Apple on iOS, and with Apple or Google on Android. You are responsible for keeping the account you sign in with secure.

Not Medical Advice

Weighly is a self-tracking tool to help you record your weight and goals. It is not a medical device and does not provide medical, nutritional, or health advice. Do not rely on it to diagnose, treat, or manage any health condition. Always consult a qualified healthcare professional before making decisions about your weight, diet, or health, and seek professional support if you have any concerns about disordered eating.

Acceptable Use

• You must be at least 13 years old to use Weighly.
• You agree to use the app lawfully and not to misuse, disrupt, reverse engineer, or attempt to gain unauthorised access to it or our systems.
• You agree not to submit unlawful, infringing, or harmful content through Help and Feedback.

Your Content

You keep ownership of the feedback and images you send us. By submitting them, you grant us a licence to use them to provide support and improve the app, and you confirm you have the right to share what you submit.

Your Data

Our handling of your information is described in our Privacy Policy. Your weight entries, goals, photos, and food diary are stored on your device; you are responsible for your own device backups, as we do not back up on-device data. Deleting the app or your account removes data as described in the Privacy Policy.

Apple Health

On iOS, with your permission, Weighly can read data from Apple Health (such as workouts, energy burned, heart rate, and steps) to show your activity and personalise your calorie targets. This data is processed on your device only, is never used for advertising or marketing, and is never sold or shared — see the Privacy Policy for details. Figures derived from Health data are estimates: they are not medical measurements, and the Not Medical Advice section applies to them in full. You can withdraw Weighly's Health access at any time in the Health app or iOS Settings.

Intellectual Property

Weighly, including its name, design, features, and code, belongs to BitCraftery and is protected by law. You may not copy, modify, distribute, or create derivative works from any part of the app.

Disclaimers

Weighly is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not guarantee that the app will be uninterrupted or error-free, or that any data or calculation it shows is accurate.

Limitation of Liability

To the fullest extent permitted by law, BitCraftery is not liable for any indirect or consequential loss, or for any loss of data, arising from your use of the app. Nothing in these Terms limits any liability that cannot be excluded under applicable law, including your statutory rights as a consumer.

Termination

You may stop using Weighly at any time and delete your account from within the app. We may suspend or end your access if you breach these Terms. Provisions that by their nature should survive termination will continue to apply.

Apple App Store Terms

The following terms apply because you obtained Weighly from the Apple App Store:

• These Terms are between you and BitCraftery only, not Apple. Apple is not responsible for the app or its content.
• Your licence to use Weighly is limited to use on Apple-branded devices you own or control, and as permitted by the App Store Usage Rules, including any Family Sharing rules.
• BitCraftery, not Apple, is solely responsible for the app and for providing any maintenance and support. Apple has no obligation to provide support.
• BitCraftery, not Apple, is responsible for any product warranties, whether express or implied. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund any purchase price paid for the app (the app is free, so no purchase price applies); to the maximum extent permitted by law, Apple has no other warranty obligation.
• BitCraftery, not Apple, is responsible for addressing any claims relating to the app, including product liability, legal or regulatory non-compliance, consumer protection, and claims that the app infringes another party's intellectual property.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Google Play Terms

The following terms apply because you obtained Weighly from Google Play:

• These Terms are between you and BitCraftery only, not Google. Google is not responsible for the app or its content.
• Your use of Weighly must also comply with the Google Play Terms of Service.
• BitCraftery, not Google, is solely responsible for the app and for providing any maintenance and support. Google has no obligation to provide support.
• BitCraftery, not Google, is responsible for any product warranties, whether express or implied, and for addressing any claims relating to the app, including product liability, legal or regulatory non-compliance, consumer protection, and claims that the app infringes another party's intellectual property.

Governing Law

These Terms are governed by the laws of England and Wales. This does not affect any mandatory consumer-protection rights you have in your country of residence.

Changes to These Terms

We may update these Terms from time to time. We will revise the date above and, for significant changes, let you know within the app. Continued use of Weighly after changes take effect means you accept the updated Terms.
